2Description of Service

Xamine.ai provides AI-powered personalized exam preparation services, including but not limited to:

• Personalized exam generation and practice
• Performance analytics and insights
• Rank prediction and assessment tools
• Question generation (Qraft)
• Institutional management tools for coaching centers

3User Accounts

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4User Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to any portion of the Platform
• Interfere with or disrupt the Platform or servers
• Share your account credentials with others
• Use automated systems to access the Platform without permission
• Reproduce, duplicate, copy, or resell any part of the Platform

5Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Xamine.ai or its content suppliers and is protected by intellectual property laws. The AI-generated questions, exams, and analytics remain the intellectual property of Xamine.ai.

6Payment and Subscriptions

For paid services:

• Subscription fees are charged in advance on a recurring basis
• All fees are non-refundable except as required by law
• We reserve the right to change our pricing with 30 days notice
• You authorize us to charge your payment method for all fees
• Failure to pay may result in suspension or termination of service

7Free Trial and Free Tier

We may offer a free trial or free tier with limited features. We reserve the right to modify or discontinue free offerings at any time. Free tier users are limited to 2 personalized exams per month and certain features may be restricted.

8Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy. We use your performance data to improve our AI models and provide personalized recommendations.

9AI-Generated Content

The Platform uses artificial intelligence to generate questions, exams, and predictions. While we strive for accuracy:

• AI-generated content may contain errors or inaccuracies
• Rank predictions are estimates based on historical data
• We do not guarantee specific outcomes or results
• Users should verify important information independently

10Institutional Accounts

For coaching institutes and educational organizations:

• Institutional accounts require separate agreements
• Pricing is based on number of users and features required
• Institutions are responsible for managing their users' access
• Bulk pricing and custom features are available upon request

11Termination

We reserve the right to terminate or suspend your account and access to the Platform at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms of Service
• Is harmful to other users, us, or third parties
• Violates applicable laws or regulations
• Is fraudulent or involves unauthorized use

12Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

13Limitation of Liability

To the maximum extent permitted by law, Xamine.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

14Indemnification

You agree to indemnify and hold harmless Xamine.ai, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Platform or violation of these Terms.

15Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes via email or through the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

16Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.
